Mediation is one of the ways in which couples can chose to try to reach an agreement without involving the court in their case. The process involves a qualified mediator helping you and your ex-partner to find solutions to issues arising from your relationship or family breakdown.
Our video explains the mediation process.
Mediation tends to be a more open and amicable process in contrast to the traditional option of going to court. If couples engage in the process in the spirit of goodwill and are cooperative and open with each other, the potential for stress and anxiety is greatly reduced.
What’s more, people generally find the costs of mediation to be considerably lower in comparison to using the court process to resolve any issues resulting from family breakdown.
Our video explains the benefits of using mediation to resolve issues resulting from family breakdown.
The mediation meetings will focus on the issues that are important to you and your ex-partner, which might be the children, the financial arrangements or other day to day concerns arising from the relationship breakdown. The pace of the mediation will be decided by both you and your ex-partner and meetings can be arranged at a mutually convenient date and time.
Tisshaws have three qualified mediators, Richard Adams, Hana Khodabocus and Lidia Farrell. As well as being family lawyers, Richard, Hana and Lidia have undergone specialist and rigorous training to become mediators. While a mediator does not provide legal advice, they can help to guide couples and families to find appropriate outcomes for their particular circumstances.
Hybrid mediation helps couples to reach an agreement in a legally supported environment. Each party has their solicitor present during the mediation to offer legal advice and guidance when necessary. It can help couples to feel supported and empowered, and make mediation a faster and more cost effective process.
Our video explains the process of hybrid mediation.
At the end of your mediation, the mediator will provide you with a Memorandum of Understanding which will set out what has been agreed. If your case is about financial matters, this needs to be drafted into a Consent Order to ensure it is enforceable.
As mediation is a totally impartial process, we are unable to offer you mediation services if one of our lawyers has already advised you about your case. So please ensure that you specify that you are looking for a mediator when you make your initial enquiry.
